If the seller claimed that it was in good condition, then you should definitely try to get a refund.

It was from a local retro shop. He said he'll take it back. I'm just disappointed because it was looking to be a really cool game. And I'll probably never find a complete copy that cheap again.

You could always keep the broken copy for the case and manual and buy another loose disc on eBay.
